Clans can be created anywhere, people. However an "official" situation for them would be at battlegrounds; yet that does not mean that you must go there and register your clan there to make a clan. If you wanted to, you could just create a clan, and make sure you become well known. You could even do this in one of those old Java chatrooms, and it would still be valid.
The only major difference about having a clan that has its "headquarters" situated in battlegrounds, is that the clan can take place in the clan wars without much issue.

..Then again, when was the last time you've ever seen another clan war?
