And why wouldn't Marvel be able to touch it if it was at Newgrounds?

First off, the XMvsSF online site requires a massive amount of web hosting space....space that Newgrounds would surely NOT provide for such a site.

Second-off, if TMy submitted XMvsSF to newgrounds, he'd be submitting ILLEGAL material to newgrounds. In which case, TMy would get sued for distributing the site, and Newgrounds would get sued for buying the site.

But still, like I first said....just because Newgrounds would be hosting XMvsSF online doesn't mean that Marvel can't shut it down...AGAIN.



However, I just lo-ove how you just abandoned our previous argument....guess I proved that Marvel IS the good guy.

instead of stating the facts over and over again (which i think i just did -_-;), i want to thank u, tmy, for all ur time and effort that u've put into this site, it really has been great. but, i wouldn't say the dream has died, as many of you are saying. i'd rather say it was fulfilled. u did make a site that a lot of people enjoyed, old and young, created a community with people all over the world, and u did provide tribute to the people behind marvel characters, even if they are doing this to u. also, because of this site, u've made a lot of people friends, have clans, and even rivalry. i say u've accomplished a lot. and for that, i thank u again. and hope that the dream HASN'T ended and that it can somehow continue on.

and to the friends, rivals, high rankers, people who had just started, vets, etc. it really was great time and the site wouldn't be what it is without you all. i thank u for building and filling this community of ours.

ok answer to the first question because newgrounds has a copyright and there is like millions of flash g@mes that are might be illegal if they were on a custom site of there own answer

Newgrounds has a copyright that protects ORIGINAL sites. If Newgrounds hosts and runs a site that VIOLATES an existing copyright law (like TMy and Project X has done), then Newgrounds is screwed. Therefore, if Newgrounds hosted XMvsSF, and Marvel caught wind of it, they can shut down Newgrounds just like they shut down Project X.

your third question what the hell are you taking about im saying what if e submited the g@me not the site and if he submites the site then we can play it at newgrounds and im sure that newgrounds will take it and like it plus like i said before marvel cant touch newgrounds im not totaly sure why but they cant because there is thosands of g@mes in newgrounds that have beed submited by flash g@me makers and they submit them there cause im guessing no marvel capcom ext. cares about newgrounds or they cant touch newgrounds for some reson!!

Just because they HAVEN'T yet doesn't mean that they CAN'T. The site itself is not illegal. However, if ANY site hosts and runs the site without Marvel's permission, THEN the site is illegal. You really want to test Marvel's capabilities? I can GUARANTEE that if Newgrounds was to host XMvsSF online, Marvel can shut them down. If Newgrounds hosts XMvsSF without Marvel's permission, they're breaking the same copyright laws that TMy broke with Project X.

i just created this account cus i heard wat happened..i cant believe it..lousy selfish business ppl and flipin marvel...#### them :angryfire: . i do know a way to keep the site up... normally in fighting sites the programmin for the character's movement and attacks are the same...so the different characters are more one character wit many different skins of mods....still wit me. now...since marvel wont let use there characters..we wont..cus we dont have a complaint from capcom do we? anywho....instead of closin the site just replace the marvel characters with more capcom characters or made up ones..and create a whole new site...this will show those marvel bastards :p

The owner of this site has CLAIMED to the players that he had a deal with you allowing him to run the site, and you discover that he is receiving "donations" from the players to keep the site running.

Now, not only is the owner of the site plagiarizing your material for his own purposes, but he's also receiving time from players in order to continue doing so. Now, this basically means that the owner could be making a profit off of a site that illegally uses your copywritten material without your permission, and you're not getting ANY time. Wouldn't you be pissed that you're now getting gyped out of time AGAIN?

Furthermore, after you shut down the site, would you REALLY decide to let him keep running the site, just because a bunch of kids email you saying how they like the site? I hope not.

a guy to us known as tmyapp had a site u made him remove for not have a license to use ur characters. i played that site many times and enjoyed it it inspired me to buy marvel stuff i vought 3 spider man posters i vought one hulk poster i luv marvellll now but i would have never even knew what marvel was if it wasnt for the site tmyapp made i kno u are getting alot of letters like this but this isnt hurting ur income the maker of the site received time from ppl to help only the site he never profited off of this site and it has taken him awhile to get the site where it is now were talking about he had to be on day and night and about ppl sending him time that was on freewill we were able to play without sending time but sum of us chose to take it a lil further and donate time to help his site out this inspired me to buy marvel products now marvel is gona take away my inspiration to like marvel now why would u do that u dont kno how this has actualy helped ur company marvel i hope u see this and i hope u are inspired to give tmyapp his license to endurse those characters giving marvel full credit which he always gave u guys before and in the introduction it said dont use drugs now that us a nice guy to advise us to do the right thingi hope u see what i mean and bring the site up

I'm quite sure we can do lot's even with just a forum... even if it was originally intended for site purposes only, this forum was for a community of people to come into and talk. OK, they wan't $$ right? How about this idea, we suggest that we use this place for promoting ground FOR marvel with various updates and news about marvel products and such and such throughout the g ame and site, like when we're waiting for it to connect or load, or when you're waiting for the other guy to choose their player. I know this may sound like a bad idea to some, but i'm willing to tolerate it if it'll save the place. SO by doing this, we advertise for FREE. And i'm sure there are LOTS of people who come here and will see the promotions, thus, putting some more mula in Marvel's hands.

What do you think? A business proposition? Because I do agree with Karma, they're not going to do jak unless theres something in it for them, am I correct?

Personally, I doubt everybody's hopes of retreiving the site.. it is gone for good! Do you really believe Marvel would reconsider to a single person? Even with the entire fans begging right now, TMyApp is the only one responsible for the abililty of the site..

tmyapp as always said to us that this site was FAN BASED and was in no one affiliated with marvel or capcom ! which basically meant that he didn't have any special permission from any of the sus mentionned companies !

ok, as for marvel, yeah they were in their rights, but tmyapp was in his rights to make a fan made site based off their product !

i mean that if you love something so much, you would think of doing some memento, do you see them going to shut down every single video that was made off their characters ? do you see them shutting down every other sites that offers biography of their character ?

As the site grew, so to did these fan creations. Many of the veterans can remember the first such site, Senshukentaikai, which started the fan created community. More recently, a new forum has appeared which rivals in popularity the official forum--Battlegrounds. It is my opinion that these sites were not popular soley because of the online site, but rather because of the enthusiam of Marvel and Capcom fans. Thus, the site going down indefinately, while unpleasant, need not be the end of our community.

There has also been much anger at marvel for their actions against us, but I would like to make it understood that we are not the only site that has been targeted by Marvel. Some people flame Marvel as a way of taking out their frustration, but let us not forget that it was them who provided us with such characters as Onslaught, Wolverine, Spiderman, and Sentinal.

I hope I speak for us all when I say that it has been loads of fun, and yet I do not see TMyApp as someone who would roll over this easily....while Marvel does indeed have copyrights, they are not Capcom, and thus parts of the site are still fine. In anycase, no matter what happens, I do not feel that this site has been in any way a waste. TMyApp has never done anything in this site as a way of raising time, or for ANY personal gain. He has done it SOLEY for you, the loyal fans, in the hope that people would appreciate and enjoy his program.

While it may seem that this site is dead, knowing TMyApp, I'm sure that he will find some way of bringing it back online, even if it means removing the Mrvel characters. Perhaps we can eventually make Marvel see that we intend this site only as a fan based tribute to their creative genius, but until then, we need to sit tight. Again, this need NOT be the end. The site may be down, but the community is still as strong as ever. Rather than being angry about the events that are taking place, I think we should look back on the wonderful experience we all have had playing Xmen Vs Streetfighte Online. We have had two and a half years of entertainment--a VERY long time in computer gaming--and it would be a waste to forget that. In my opinion, this community has been nothing but a stunning success. So if you decide to leave this community, I hope that it is not with anger, but with appreciation.

Over the past two and a half years, TmyApp and LeftyFB have created a community of over 50,000 fans and inspired numerous other forums, fansites, and clans. As the site grew, so to did these fan creations. Many of the veterans can remember the first such site, Senshukentaikai, which started the fan created community. More recently, a new forum has appeared which rivals in popularity the official forum--Battlegrounds. It is my opinion that these sites were not popular soley because of the online site, but rather because of the enthusiam of Marvel and Capcom fans. Thus, the site going down indefinately, while unpleasant, need not be the end of our community.

There has also been much anger at marvel for their actions against us, but I would like to make it understood that we are not the only site that has been targeted by Marvel. Some people flame Marvel as a way of taking out their frustration, but let us not forget that it was them who provided us with such characters as Onslaught, Wolverine, Spiderman, and Sentinal.

As much as HATE what Marvel did, I agree with them. I seriously thought that this site was aprt of Marvel, and now that I find out it wasn't, I undestand why they took legal action.
Marvel has a copyright or their characters, and nobody should distrubte them without Marvel's written autorization. This site extend to the point of not only distributing the characters, but making a fully playable site that was very similar to to Marvel's site, which it totally out of the question.
This site could have easily lowered Marvel's marketing becuase not many people would by a site if they can play it online, and for free.

Besides I never really liked the most of the Marvel characters in the site anyway.. eg Cyclops has pants on the outside and are bright yellow! hahahahahahaha!!!

Hello all, I am from the Freedom Reborn (http://freedomreborn.net) forums. You probably have heard about some of our fansites being shut down by Marvel as well, but maybe you haven't. I want you to know a couple of things-
A. Although it is very stupid, they have perfect legal rights to do this.
B. Therefore, only mail can convince them that this is mainly a promotion of marvel products.
C. BUT DO NOT SEND HATEMAIL! Please be civilized. If you send a letter full of grammatical and spelling errors threatening marvel, we will lose our chances to win the fight. Please have people proofread your letters.
So, a petition to keep our fansites and XvsSF alive along with many civilized letters would be great.

It astonishes me that Marvel could shut this great site down there and then, without even realising the consequences of such drastic actions. Which is of course, piracy! Now that they have done this, more people will probably go and get M.A.M.E (like me) and find a ROM site and download the full Arcade version of X-Men vs. Street Fighter instead. Surely Marvel should be more worried about blatant and repeated software piracy of commercial titles than one little Flash site which so many people enjoyed.

And what about Capcom? (Who I prefer to Marvel anyway! :D ) Why haven't they come along recently and ordered the closure of this site? Whether we will never know if in time they may have taken Marvel's course of action we will never know... But it was Marvel who came and dealt that horrible blow first, so we only have them to blame, I guess!

Anyway, as there seems to be no way I can play this online against other people anymore, guess it's off to a big ROM site to download a commercial arcade ROM of XMVSF for me then, as I wouldn't have to if the Flash site was still online! Shame on you Marvel for doing this! SHAME ON YOU! :angryfire:

Marvel by going against these little Fan Sites, they are killing their own Fan community...or maybe they are doing that because their comics are not giving them the profit they used to back in the days.
I say: Why don't you guys remove all the Marvel characters and stick with the Street Fighter characters which are property of Capcom.
Capcom is cool and they don't do that to their Fans. Heck if you write to Capcom offering to make this online g.ame a new feature on their site, they just might agree with it.

This site can keep going well without those marvel characters.
If you take my idea of just having Street Fighter characters and showing it to Capcom USA, you probably might get hired by them to add this g.ame as a new feature for their site.
Today, Capcom is going strong with advertisements for their g.ames so there is still hope for this site.
The team of DreamWave (they make comics) showed Capcom some of their art and Capcom liked it and now they are making comics for them from series such as Megaman, Devil may Cry, NightStalkers, Maximo.

So that's my 2 cents...so just comply with the Marvel rules and remove their characters from the site and site and let's forget them....that will teach them and will certainly teach their pockets because as of now... because of this I'm not buying nothing that has Marvel in it and excuse me...Im going to go now to burn some comics I dont read any more like xmen...
Now Marvel...say bye to one more loyal fan and costumer...Im going to devote my time and time to buy DreamWave's comics. :angryfire:

Well everyone here's my final rant/observation or whatever you wanna call it....

Maybe you guys don't understand the legal implications involved with this... you guys are using copyrighted characters in this site. meaning you would have to get written permisson to use them (which normally involes a % of your profits I.E. your 'project funding' )

Because you did not have this permisson they have taken action so unless you reach some final finacial aggreement 'THE DREAM IS DEAD!' well in this project's case anyway.

I'm quite surprised this didn't happen sooner and I honestly thought CAPCOM would be the first people to get a lawsuit hassling you over their precious Ryu chracter but hey live and learn...

Go on with your lives people unless this project gets some new funding IT'S OVER! If you really can't live without it get yourselfs an emulator with the REAL site... unless of course you're too dumb to use one ???

Well, I was only here for a while. I come back to see how the site is doing and see. "site over." I'm saddened to see how Marvel does this to fans. (I'm not a big Comic book reader, I like the X-men. But I don't read them.) And this is after unlocking everything on my X-box Marvel vs. Capcom 2. :(

For those of you bashing Snake. He is right though, Tmy shoulda asked Marvel AND Capcom if it was alright to use there characters for an online site. Don't snap at him, because international law prohibits using trademarked characters without permission. (Though there is Fanart and Fanfiction...*shrug*)

Tmy was basically making a online version of the site. Which was basically a port. Meaning that Tmy was piriating (in a sense) the site. He wasn't making a profit. Which under the GNU licence. (For open-source stuff) was ok. But in in Marvels eyes, it wasn't. Because they are a business and want to make time. If Tmy asks them nicely, and they still say no. Even if he requested that he would have people pay for the site mounthly and have a staff of people working on it. (*shrug*) and htey still say no. What do you think the fans are going to do? Marvel is a corperation. They only think on time terms. They don't think about FUN, they think about profit. The more profit they make, the more they can keep the company running, and give you the things you love.

Tmy did put a disclaimer up. But, as the letter says. "It was misleading." If Tmy worded it diffrent, or asked Marvel if he could reword it, and they said no. Then that's final, case closed.

I loved playing online. Seeing how I don't have broadband, for my X-box, nor my PC...it was nice being able to fight people as Chun-Li, even with lag. And I got to talk to Tmy once. *faint* He was a nice guy, even though it was about 1-2 AM, EST. XD.

Those of you that are asking Tmy to make a new site with Capcom characters. That's a stupid idea. Because if Capcom doesn't allow it. The same thing that is happining here is going to do it to that.

But, you have an idea there.

He is using Flash, which is open. If Tmy took everything out, but distrubuted the engine and how to make stuff under the GNU licence. What would you think of that? He would be scott-free, because he isn't doing anything for that. He is just distributing an engine. This would be the BEST option. Because if Tmy contributed, and we all made new chracters. Just imagine the progress this would make.

Each person could help devlop the characters, or stages. Think about it. 50 people on one character, synching the moves and crap. That would take less than a mounth or two to do. Compared to Tmy doing everything on his own and taking a year or six mounths to get it all done for you.

I implore you, Tmy. Release the engine, under the GNU licence, and instructions on how to make a site with it. You would make tons of people happy. Plus, if anyone charged time on your engine. You could easily sue them. ;) Major plus.

In closing, I have to say. My liking of Marvel is lessened, but not dead. I hope they really reconsider. With peopel pestering them, they may. But we know how corperations are.

Tmy, you were a nice guy when I talked to you. Stay that way. You and your biggrin. :biggrin: when I was lurking here, it was funny. Seeing people with sigs saying they were going to out biggrin you. XD.

Everyone, stay cool. Oh, and those of you that had 'sites and kick-arse sigs. Band together and make a website. I would really love to see tutorials on how to make KKS's sig. That was really cool. :)

In (another) closing, I'd like to say. "Marvel, I hope you reconsider, otherwise your just going to have fans turn away from you. Tmy, I hope you release the engine for fans to help you make a new site with. Everyone, don't send heated mails to Marvel, but nice, spellchecked, polite and explaining every reason e-mails to Marvel to have them reconsider."

Hey wait a sec Tm i got an idea what if u can add streefighter alpha3 online and u add alot of charaecters and with no lag this would be great try it make sure u ask permission though!! and don't do nothin that might get this gam shutdown!!! am using this as an example!!! Thats my advice am tierd of playing these stupid broing sites online. ???
dude your an idiot. he can't make a site with out lag. also he can't make alot of characters at once. it takes time. if your getting bored just leave. i doubt anyone would care.

I have one question . . . how can a site get bored? It has no mind, it has no attention span, it cannot get bored.


But anyhoo, are there any good pixelists on the forum? I'm not talking about PSP or Photoshop, I'm talk'n 'bout pixel by pixel.
